The Common Reporting Standard (CRS) is an internationally agreed standard for the exchange of financial account information between jurisdictions for tax purposes, to better combat tax evasion. Launched in 2017, the CRS is now live in over 90 countries. Information exchanges also occur between the UK, its crown dependencies and Germany. 2023 has seen a notable increase in the number of investigations and assessments by the German tax authorities in relation to trust structures in the UK, the Isle of Man and the Channel Islands (as a result of reports containing information about German settlors, beneficiaries, protectors and others). This calls for a proactive response. Flick Gocke Schaumburg (Germany) and Charles Russell Speechlys (UK) are joining forces to host a lunchtime seminar, where they will illustrate the tax consequences in Germany arising from trust structures and explore the current landscape for cross-border investigation and enforcement activity and the potential consequences under criminal tax law in Germany. Lunch will be provided.

The following core topics will be discussed:

  • Current situation | Common Reporting Standard
  • Overview of German Trust taxation
    • What are the differences?
    • When the trust is a separate entity
    • How to move forward

  • Overview of the current investigative landscape and co-operation between the German and UK tax authorities
  • Potential consequences for German individuals from a criminal tax law and white-collar crime perspective

The event will be held on September 28, 2023 at Charles Russell Speechlys' main office in London.
